Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the MenuM8 application (the "Service") operated by MenuM8 ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

MenuM8 provides a menu costing and recipe management platform for restaurants and food service businesses. The Service includes:

  • Recipe and product management
  • Ingredient cost tracking
  • Menu costing calculations
  • Supplier management
  • Allergen tracking
  • Report generation

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription and Payment

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis.

A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide accurate and complete billing information including full name, address, postcode, and valid payment method information.

All subscriptions include a 14-day free trial period. You will not be charged during the trial period. After the trial period ends, your subscription will automatically renew and you will be charged according to your selected plan.

5. Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.

We do not provide refunds for partial months or years of service. However, if you cancel during your free trial period, you will not be charged.

6. User Data and Privacy

We take your privacy seriously. All data you enter into the Service remains your property. We will never sell, rent, or share your data with third parties except as required by law or as necessary to provide the Service.

Your use of the Service is also governed by our Privacy Policy. We store your data securely using industry-standard encryption and security measures.

You are responsible for maintaining the confidentiality of your data and for all activities that occur under your account. You agree to back up your data regularly, as we are not responsible for data loss.

7. Acceptable Use

You agree not to use the Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To attempt to gain unauthorized access to the Service or related systems

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of MenuM8 and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent ofMenuM8.

9. Service Availability

We strive to provide a reliable Service, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

10. Limitation of Liability

In no event shall MenuM8, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use or alteration of your transmissions or content

11. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

14. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
